This Terms of Service (hereinafter referred to as “this Agreement”) constitutes a legally binding agreement between you and the Company. By registering an account, accessing, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by all the terms of this Agreement.If you are accepting this Agreement on behalf of an entity (such as a company or organization), you represent and warrant that you have the authority to bind that entity, and the term “you” in this Agreement shall refer to that entity.
The Service is an AI‑driven website micro‑survey platform designed to help you gain insights into visitor behavior, optimize user experience, and improve business conversion through real‑time behavior analysis and intelligent survey triggers. The Service includes our website, software, SDK, API, applications, related tools, and all associated services.
You must be at least 18 years of age and have full legal capacity to register and use the Service.
You agree to provide true, accurate, complete, and up‑to‑date information during registration. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. If you discover any unauthorized use of your account or any security breach, you must notify us immediately.
The Service and all of its content (including but not limited to software, SDK, designs, text, graphics, logos, trademarks, etc.) are owned by or licensed to the Company and are protected by applicable intellectual property laws. Unless expressly authorized in this Agreement, you may not copy, modify, distribute, sell, or use any part of the Service.
All content you create and collect through the Service (including surveys, data, and visitor feedback) remains your intellectual property. You grant the Company a limited, non‑exclusive, transferable, worldwide license to use such content solely for the purpose of providing the Service to you (e.g., storing your surveys, processing and displaying data). This license will automatically terminate when this Agreement is terminated.
You agree to pay all applicable fees according to the service plan you select. Unless otherwise specified, all fees shall be paid in USD or other designated currencies available in your region. All payments are non‑refundable unless expressly stated in this Agreement.
Unless you cancel your subscription before the renewal date, the Service will automatically renew and the applicable fees will be charged to your designated payment method.
If a free trial period is offered, your account will automatically convert to a paid plan upon its expiration unless you cancel the subscription before the trial ends.
You may terminate this Agreement and your use of the Service at any time via your account settings or by contacting us.
The Service is provided on an “as is” and “as available” basis without any express or implied warranties. The Company does not warrant that the Service will be uninterrupted, error‑free, completely secure, or available at all times. You use the Service at your own risk.
To the maximum extent permitted by law, the Company and its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including but not limited to loss of profits, data loss, or business interruption) arising from your use or inability to use the Service, even if we have been advised of the possibility of such damages. In no event shall the total liability of the Company to you exceed the total amount of fees you paid to the Company in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, and employees from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service.
This Agreement (including any policies and documents incorporated by reference) constitutes the entire agreement between you and the Company regarding the use of the Service.
This Agreement shall be governed by the laws of State/CountryofYourCompanyState/Country of Your CompanyState/CountryofYourCompany, without regard to its conflict of law principles. Any dispute arising out of or related to this Agreement shall be submitted to the competent courts located in CityofYourCompanyCity of Your CompanyCityofYourCompany.
If any provision of this Agreement is found to be illegal or unenforceable, the remaining provisions shall remain valid and enforceable.
Failure by either party to exercise any right under this Agreement shall not be deemed a waiver of that right.
